To protect our clients and recover insurance coverage when litigation arises, we provide contract drafting and revision services. We further consult clients in tendering the defense based upon the contractual provisions and allegations that are the subject of the litigation.
Represented national general contractor in catastrophic personal injury litigation arising from numerous alleged OSHA violations that involved complex tenders of defense to several insurance carriers. The result was a favorable resolution prior to trial, utilizing funds of other parties’ insurance carriers to protect a large self-insured retention of the client by several targeted tenders.
Represented sub-contractor accused of construction deficiencies of a remodel of the McDonald’s headquarters in Oak Brook, Illinois. The result was a dismissal of the sub-contractor from the litigation, protecting the sub-contractor and its assets from exposure well in excess of the potential coverage afforded.
Represented a hydro-drilling contractor that was involved in a renovation of Indiana’s largest electrical facility from a claim involving exposure in excess of $90 million. MRV ultimately obtained a summary judgment on behalf of the contractor after an aggressive defense that demonstrated that the damage causative of the underlying collapse of the site infrastructure was unrelated to the work of the client.
Represented a large concrete truck company and supplier after a cave-in on a municipal job site caused the deaths of two workers. MRV obtained a defense verdict at trial.
Represented a national property developer in connection with claims by various contractors for payment, after a building began to deteriorate prior to completion of the project. MRV proved that the defective work resulted in expenditures far exceeding the alleged outstanding fees claimed, resulting in a walk-away by the unpaid contractors.
Represented the owner of a commercial high-rise building that, upon completion, had numerous areas of water intrusion. Through aggressive investigation, retention of specialty experts and the use of limiting motions, MRV was awarded a substantial recovery on behalf of the owner.
Represented largest road and bridge construction contractor in Illinois in connection with claims that construction signage, supervision, and related work resulted in the deaths of two drivers and substantial injuries to three additional individuals. During the course of a mediation, MRV resolved the matter for well less than the court’s prior recommendation.
Represented general contractor in connection with catastrophic injuries sustained by worker after contact with power lines. The worker claimed that the provided equipment failed and that supervision was inadequate. Ultimately, the court granted summary judgment in favor of the client despite an $8 million settlement demand leading up to the hearing on the dispositive motion.
